Welcome to EasyQuote by InsSwag (“EasyQuote,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your use of the EasyQuote mobile application (the “App”) and any related websites, services, and tools provided by InsSwag. By accessing or using EasyQuote, you agree to these Terms. If you do not agree, please do not use the App or related services.

1. Overview

EasyQuote by InsSwag is a subscription-based mobile application designed to help licensed insurance agents (“Agents”) capture, organize, and manage potential client leads efficiently. EasyQuote provides a simplified lead collection form, automated notifications, and communication tools to streamline the agent’s follow-up process.

2. Eligibility

You must be at least 18 years old and legally permitted to enter into this agreement to use EasyQuote. By subscribing, you represent that you are a licensed insurance agent and that all information you provide is accurate and complete.

3. Subscriptions and Payments

  • Subscription Fees: Access to EasyQuote requires a monthly subscription fee of $14.99 USD, billed through the Apple App Store or Google Play Store.

  • Billing and Renewal: Subscriptions automatically renew each billing cycle unless canceled at least 24 hours before the renewal date.

  • Cancellation: You can manage or cancel your subscription through your app store account settings.

  • Refunds: All payments are handled by the respective app stores. We do not issue refunds directly. Please refer to Apple’s or Google’s refund policy for more information.

4. Agent Responsibilities

As a subscriber, you are responsible for:

  • Maintaining the confidentiality of your account credentials.

  • Ensuring that all client and lead data you enter complies with applicable privacy and data protection laws.

  • Using EasyQuote only for lawful, professional purposes.

  • Ensuring that all information entered into the App or associated web forms is accurate, current, and not misleading.

You acknowledge that you are solely responsible for any communications you send to your leads or clients using data collected via EasyQuote.

5. Lead Data Collection

EasyQuote provides each subscriber with a unique web link (landing page) for collecting prospect information.

  • Any personal data collected from prospects via these forms is transmitted directly to the subscribing agent.

  • EasyQuote acts as a data processor for this functionality, not a data controller. The subscribing agent is responsible for compliance with applicable data privacy laws (e.g., GDPR, CCPA).

  • EasyQuote does not access, sell, or share lead data entered by prospects.

6. Use of Third-Party Services

EasyQuote integrates with third-party services to operate the App and manage subscriptions, including but not limited to:

  • Firebase (Google) – data storage and authentication.

  • RevenueCat – subscription management.

  • SendGrid (Twilio) – email automation.

  • Formstack or similar – lead form hosting.

By using EasyQuote, you acknowledge that these services are essential for operation and agree to their respective terms and privacy policies.

7. Prohibited Uses

You agree not to:

  • Use the App to collect, transmit, or store unlawful, defamatory, or fraudulent information.

  • Attempt to reverse-engineer, copy, or resell EasyQuote or its software components.

  • Share your account with non-subscribers.

  • Interfere with EasyQuote’s servers, APIs, or security features.

Violation of these Terms may result in suspension or termination of your account without refund.

8. Intellectual Property

All content, trademarks, logos, designs, code, and software associated with EasyQuote by InsSwag are the property of InsSwag and are protected by copyright and trademark laws.
You may not copy, reproduce, distribute, or create derivative works without prior written consent.

9. Termination

We reserve the right to terminate or suspend your account at our discretion, without notice, if we believe you have violated these Terms or misused the App. Upon termination, all rights granted to you will cease immediately.

10. Disclaimer of Warranties

EasyQuote is provided on an “as is” and “as available” basis.
We make no warranties, express or implied, about the accuracy, reliability, or availability of the App or related services.
We are not responsible for loss of data, delays, or technical issues arising from third-party platforms or network connectivity.

11. Limitation of Liability

To the maximum extent permitted by law, InsSwag and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising from your use of EasyQuote.
Your sole remedy for dissatisfaction with the App is to discontinue its use and cancel your subscription.

12. Indemnification

You agree to indemnify and hold harmless InsSwag, its affiliates, and team members from any claims, liabilities, or expenses arising out of your use of EasyQuote, your violation of these Terms, or your collection and handling of prospect data.

13. Privacy

Your use of EasyQuote is also governed by our Privacy Policy.
By using the App, you consent to our collection and use of information as outlined there.

14. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted at https://insswag.com/pages/easyquote-terms with a revised effective date.
Continued use of EasyQuote after such updates constitutes your acceptance of the new Terms.

15. Governing Law

These Terms are governed by and interpreted under the laws of the State of Indiana, without regard to its conflict of law principles.
Any disputes will be resolved in the appropriate courts located in [Your County and State].
